These Terms of Service (“Terms”) govern your access to and use of Buggsy (“Buggsy,” “we,” “us,” or “our”) at diybuggsy.com and its related tools (the “Service”), including bug identification, the pest library, DIY treatment guides, the paid app subscription, and the find-a-pro referral tool. By creating an account, subscribing, submitting a find-a-pro request, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Not a pest control company
Buggsy provides general pest-identification and educational information. We are not a licensed pest control company, and nothing on the Service is a substitute for an in-person inspection by a licensed professional. Bug identification is provided by an AI model and can be wrong — always confirm identification before acting, especially for pests that can carry disease, cause structural damage (like termites), or be dangerous to handle. Treatment guides describe general, industry-standard approaches; they are not tailored to your specific property, local regulations, or the exact product you purchase.
2. DIY pest control is at your own risk
If you choose to treat a pest problem yourself, you are solely responsible for reading, understanding, and following the label instructions on any product you use — the label is a legal document, and following it is required by law. You're responsible for using appropriate protective equipment, protecting children, pets, and food-contact surfaces, and complying with any state or local restrictions on pesticide use. Buggsy disclaims all liability for property damage, personal injury, ineffective treatment, or any other harm arising from DIY pest control activity you undertake, whether or not it follows guidance found on the Service. 3. Find-a-Pro referral service
The find-a-pro tool is a lead-referral service only. When you submit a request, we share the information you provide (name, contact details, location, and pest details) with one or more independent, third-party pest control companies so they can contact you about your request. Those companies are not Buggsy employees, agents, contractors, or partners — they operate their own independent businesses, and any contract for service is between you and them. Buggsy does not guarantee that a recommended company is licensed, insured, or will perform work to any particular standard, and we are not a party to and have no liability for the services they perform, the prices they charge, or any dispute between you and them. Verify licensing and insurance yourself before hiring anyone.
4. Accounts
You must be at least 18 years old to create an account. You're responsible for keeping your password confidential and for all activity under your account. Provide accurate information when you sign up. We may suspend or terminate an account that violates these Terms or is used fraudulently or abusively.
5. Subscriptions and billing
The DIY plan and Pro training plan are currently free to use and no payment is being collected. When paid plans are reintroduced, they will be billed in advance on a recurring basis through Stripe and renew automatically until you cancel. You'll be able to cancel at any time; cancellation stops future renewals but we don't provide refunds for the current billing period already paid for, except where required by law. We may change subscription pricing going forward; existing subscribers will keep their current price unless we notify you of a change to it.
6. Affiliate links and product recommendations
Buggsy is a participant in the Amazon Services LLC Associates Program and may include other affiliate links. We earn a commission on qualifying purchases made through these links at no extra cost to you. Product recommendations reflect our professional judgment about what a real pest control operator would use for a given pest, not a guarantee of results. See our Affiliate Disclosure for details.
7. Photos you submit for bug identification
When you upload a photo for identification, you grant us permission to process that image (including sending it to our AI identification provider) for the purpose of returning an identification to you. Don't upload photos that contain other people's personal information, or that you don't have the right to share.
8. Acceptable use
Don't misuse the Service: no scraping or automated bulk data collection, no submitting false or abusive find-a-pro requests, no attempting to bypass subscription paywalls or account security, and no using the Service in a way that violates applicable law.
9. Intellectual property
The Service's content — including the pest library, treatment guides, graphics, and the Buggsy name and mascot — is owned by us or our licensors and protected by copyright and trademark law. You may use it for personal, non-commercial reference; you may not republish, resell, or redistribute it without permission.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY. WE DON'T GUARANTEE THAT BUG IDENTIFICATION WILL BE CORRECT, THAT TREATMENT GUIDANCE WILL RESOLVE YOUR PEST PROBLEM, OR THAT ANY REFERRED PEST PROFESSIONAL WILL MEET YOUR EXPECTATIONS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUGGSY AND BEN RICHES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROPERTY, PERSONAL INJURY, OR DAMAGES ARISING FROM PEST CONTROL PRODUCTS OR SERVICES YOU USE OR OBTAIN BASED ON INFORMATION FROM THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
12. Indemnification
You agree to indemnify and hold Buggsy harmless from any claim arising from your use of the Service, your DIY pest control activity, or your dealings with a pest control company referred through find-a-pro.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Kentucky, and you consent to that jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the “last updated” date above. Continued use of the Service after a change means you accept the updated Terms.
